I just wanted to clarify a piece of news that
was misunderstood by several people. It has
been reported that another tragedy occurred last
week with a little girl from Boro Park being
sexually assaulted by "one of our own." The
reports mentioned the family turned for help to
several rabbanim, only one of whom (L'daavoneinu
Harabim) had the wisdom and the willingness to
counsel her family to report the assault to the
police, in order to utilize law enforcement
professionals to enforce the law and keep our
children safe. The family also consulted with
Assemblyman Dov Hikind who has been an outspoken
advocate for victims of crime to speak out and
to stop abuse by any means necessary including,
obviously by informing the police.
Some people apparently got the impression that
Dov himself advised or encouraged the family to
go to rabbanim first before deciding whether or
not to inform the police. I have checked into
the story personally and can assure you that
nothing could be further from the truth. That
is not what occurred and would never have
occurred. Asking a shayla in such an obivous
case of pikuach nefesh would be like seeing a
naked woman drowning and instead of saving her
immediately, first looking for a rav to ask a
shayla. This is what the Talmud calls a
"Chassid Shoyteh" a pious fool. The girls's
family, not understanding this clearly went to
the rabbanim ON THEIR OWN. Luckily, they
finally found a Rav who validated what they knew
in their hearts to be true; what every Jewish
parent knows. That this is unacceptable and must
be stopped at all costs.
The necessity of informing legal authorities has
been clearly established by Gedolim and
Rabbanim. Rav Elyashiv has published a written
tshuvah to Reb Feivel Cohen saying that it is
"for the repair of the world" for us to use the
authorities of the government we are living in
when children are being hurt in this way. Rabbi
Moshe Shternbuch said in a published news
interview "let the molester rot in jail". Rav
Herschel Shachter has stated that it is "not
only allowed but a Mitzvah to inform the police"
about an individual who is such a danger to
children's welfare. Reb Dovid Cohen has also
told several people to go to the police with
information on molesters. The Baltimore Vaad
Harabanim have written a letter signed by
virtually every Rov in that town saying that one
should utilize the services of the government
police force in investigating and protecting
from chlid sexual abuse, as rabbis do not have
the expertise to do forensic or psychological
evalutations.
So to summarize, Assemblyman Hikind, has made it
clear that he intends to inform the authorities
whenever there is a case of a dangerous molester
in our midst, and he does not see any reason to
"ask a shayla" on such a simple matter of
pikuach nefesh. Let us hope, that in time,
more and more rabbis and parents will realize
the critical importance of following the psakim
of the above noted rabbanim, and we will finally
have some clarity in an area that has caused so
much confusion, pain and suffering for far too
long.
I personally believe that it was no coincidence
that this happened in the Shabbos when we read
about Shimon and Levi explaining the harsh and
provocative action they took when their sister
was the victim of sexual assault. They asked in
horror "Hakezona Naaseh es Achoseinu!?" "Shall
we allow our sister to be treated like a
harlot?!" Some of the commentaries on the
chumash, incidentally, point out that the reason
that the abuser's entire community was punished
collectively for the act of one man, was because
since the community did not have an adequate
justice system to apprehend the rapist and bring
him to appropriate justice, they were all
considered complicit in his act. Even though he
was the most powerful member of that particular
society, it was morally expected of them to
judge him by his actions and to punish him
accordingly. Their failure to act, their lack
of sensitivity to the injustice of an innocent
Jewish girl being raped on the streets of their
neighborhood brought them all down to the level
of the rapist and they were all equally
deserving of harsh punishment.
The lessons of this parsha are too obvious to
spell out. We must all seek to learn them and
to learn from Shimon and Levi's sense of pain
for their sister and do whatever we can to
protect our sons and daughters, brothers and
sisters, and all the children of Klal Yisroel.

Who Will End the Abuse?
It began on the radio
this summer. New York Assemblyman Dov Hikind ran a
segment on his Saturday night talk show titled "We Are
Only as Sick as Our Secrets: Sexual Abuse, Healing the
Shame," featuring graphic accounts of sexual abuse of
children in the ultra-Orthodox Jewish community in
Brooklyn.
There had been a few high-profile cases before, but this
"was when the floodgates opened," explained Mr. Hikind,
an Orthodox Jew himself. Following the show, additional
victims and their family members came forward to share
with Mr. Hikind their own stories. "Cases of sexual
abuse are not worse among the Orthodox," clarifies Mr.
Hikind. "But when there's a problem and you don't deal
with it, it gets worse." Over the past few months he has
collected hundreds of testimonies spanning several
decades, naming at least 50 alleged pedophiles across
the tri-state Orthodox Jewish community, including
well-respected rabbis and teachers.
But now these testimonies have become a source of
contention. They have been subpoenaed for a civil suit
by a lawyer representing six former students of Rabbi
Yehuda Kolko, a longtime teacher at one of Borough
Park's leading all-male yeshivas, who has been charged
repeatedly since the 1980s with sexually molesting his
students. (Last year Rabbi Kolko pleaded guilty to child
endangerment.) The problem is that Mr. Hikind had sworn
to keep the testimonies confidential.
Mr. Hikind claims he will "do the right thing" about the
subpoena without betraying the names of any of the
victims. While he will not hand over his complete list
of alleged perpetrators, he says that "we are starting
to share names" with Brooklyn District Attorney Charles
J. Hynes.
Many people give Mr.
Hikind credit for bringing much needed attention to an
issue in the Orthodox community that has frequently been
swept under the rug. (One exception to the silent
treatment was the Orthodox Union's creation of a special
commission in 2000 to investigate the sexual abuse
charges against Rabbi Baruch Lanner, leader of the
National Conference of Synagogue Youth, who was later
convicted.) He also deserves credit for getting victims
to talk at all. Mr. Hikind says that he encourages each
victim who comes to him to go directly to the police,
but no one is willing to. They are too afraid of the
repercussions for themselves and their families in terms
of reputation and marriageability.
The trouble is that
subpoena or no subpoena, he has valuable information
that is not being effectively utilized to investigate
the alleged offenders and get them off the streets. "Dov
Hikind has decided that secrecy is a more worthwhile
value than child protection," explains Marci A.
Hamilton, a professor at the Cardozo School of Law and
an expert in clergy law. By witholding the names of the
perpetrators, "he is sharing in the responsibility of
every child who is harmed by them."
What Mr. Hikind wants to do instead is tackle the issue
from within the community. He has assembled a task force
of rabbis, therapists, principals and pediatricians to
help the community respond to cases of sexually abused
children -- raising awareness, forming a registry of
teachers (so that a teacher who is removed from one
school does not simply go to another) and devising a
system of investigating allegations. Investigation is
extremely important, he adds, because "you have to make
sure an innocent person is not being thrown to the
wolves."
While Mr. Hikind's effort
is well-intentioned, Prof. Hamilton calls it "a doomed
project." Resolving cases of sexual abuse without the
legal establishment in this country "has never worked in
any other religious community," she points out, citing
the Catholic Church as an example. And the truth is,
many rabbis agree with her. According to Rabbi Mark
Dratch, the chief executive officer of JSAFE (The Jewish
Institute Supporting an Abuse-Free Environment),
"Rabbinic authorities do not have the expertise or
ability to handle these things. Making reports [to the
legal authorities] is the only way to go."
Mr. Hikind insists that his plan does not look to
circumvent law enforcement, but to collaborate with it.
The question, though, is if the ultra-Orthodox
constituency that Mr. Hikind is working with will be a
real partner in this endeavor. In the past, they have
unfortunately been resistant, worrying more about the
consequences of disparaging renowned Torah scholars than
about protecting a child's life. Some rabbis in the
community have even impeded the efforts of other rabbis
who are willing to speak out and take action. Orthodox
rabbi and psychologist Benzion Twerski resigned from Mr.
Hikind's task force for fear of tarnishing his
reputation and his family's reputation within the
community. In Williamsburg, Rabbi Nuchum Rosenberg
received threats for speaking out against abuse in his
community.
So is Mr. Hikind's plan "doomed"? It depends. If the
community is willing to take more cases to the police
rather than watching alleged perpetrators float from one
community to another, where they will no doubt prey
again, then great. But if they are not, if they succumb
to the same social pressures that have paralyzed them
for decades, then every day that goes by another
community of children is at risk.
No matter what happens, though, Mr. Hikind promises not
to reveal any victims' names. "I will not, God forbid,
destroy a person's life all over again," he says. That's
good. But let's hope another child's life is not
destroyed either.

A 27-year-old man was busted Wednesday night on charges of
sneaking into a Manhattan hospital room and molesting a
72-year-old patient, police sources said.
A nurse came into the victim's room to find Yakov Kramer
allegedly standing over the elderly man's bed at New
York-Presbyterian Hospital Columbia yesterday, sources said.
Kramer had allegedly pulled up the victim's hospital gown
and was fondling him, sources said.
The elderly victim, though frail, was able to describe the
alleged assault, sources said. The horrified nurse called
hospital security, who grabbed Kramer about 12:15 p.m.,
sources said.
"The whole story is wrong and stupid," said a woman who
answered the phone at the Williamsburg, Brooklyn, home of
Kramer's father, Jeremias Kramer.
"He is a student, a studious person," the woman said. "He
was in the hospital with his wife. She had an appointment.
Something is very wrong if someone could be arrested at a
hospital. This is a stupid, stupid mistake."
Kramer, a Hasidic Jew from Spring Valley, Rockland County,
was arrested about 9 p.m. and taken out of the hospital in
handcuffs for processing at the 33rd Precinct stationhouse
in Washington Heights.
Charges were pending Wednesday night.
Though the alleged assault was discovered about noon,
hospital staff waited more than three hours to notify
police, hospital security sources said.
"The allegations are disgusting, preying on an elderly
person, a sick patient who couldn't fight back," a police
source said.
The cloth Kramer allegedly used to clean up the evidence was
seized by the NYPD for testing, sources said.
"He didn't know the victim - it looks like he just wandered
into a room and took advantage," another police source said.
Kramer's father and relatives declined to comment as they
waited at the stationhouse.

Israel - Some
6,000 Ecstasy pills were seized Friday during a
police raid on two synagogues in Rishon Lezion's
Shikun Hamizrach neighborhood.
Local police, who
were tipped off about the drugs a few days ago,
found 3,000 Ecstasy pills and a pistol concealed
in the ceiling of a synagogue on Shivtei Yisrael
Street.
An additional
3,000 pills were found in the bathroom of
another synagogue located nearby.
Investigators
said the drug dealers, who are still at large,
apparently planned to sell the pills at a party
that was scheduled to be held in the coming
days.

צריך לבקש מכל סופר וסוחר שישלח לו צילום (קאפ"י) מתעודת ההכשר של הקלף עם
תאריך (דעי"ט) שעדיין בתוקף, וגם יתקשרו להרבנים לשאול אם ההכשר הוא על עבודת
יד או על עבודת מכונה או על שניהם, וגם ישאלו אותם אם לא הורידו ההכשר (כי
הרבנים הורידו ההכשר שלהם מכמה מפעלי הקלף בגלל שתפסו אותם עם קלף פסול וד"ל)
- ואם לא שולח תעודת ההכשר של הקלף, דע לך שהסוחר הזה והסופר שכותב על קלף הזה
בלי שראית תעודת ההכשר
אין להם נאמנות!!!
על הכתב ההכשר צריך לברר אם ההכשר הוא רק על עבודת יד או על עבודת מכונה או על
שניהם
אם הסוחר יש לו הכשר רק על עבודת יד והעבודת מכונה בלי הכשר או להיפוך אין לו
נאמנות – כמו חנות של בשר (בוטשער סטא"ר – פינק"ל בלע"ז) שמוכר בשר כשר ובשר
טריפה ביחד – האם היית אוכל מחנות כזה?
תדע לך! שאם מוכר עבודת יד עם הכשר ועבודת מכונה בלי הכשר, זאת אומרת, שזה שלקח
ההכשר רק על העבודת יד, זה רק כדי שיוכל לכסות את עצמו שיוכל לקנות הלאה מעזה
ויריחו!!!

ב"ה שאלפי אנשים
הפסיקו לקנות אצל סופרי וסוחרי סת"ם כמו שהיו סומים עד עכשיו שהאמינו להסופרים
וסוחרים ולהחניות בלי שום תעודת הכשר על הקלפים.
זאת אומרת, שאולי
רוב התפילין והמזוזות והס"ת נכתבו על הקלפים שבאים מערבים מיריחו ומעזה ומרבע
מיליון מפעלי הקלף
(PARCHMENT)
של העכו"ם שיש בכל העולם, וכל אחד שעושה חיפוש באתרי האינטרנט, רואה בעליל
לעיני כל העולם שיש יותר מרבע מיליון מפעלי קלף של עכו"ם.
על
כן מי שקונה קלף בלי הכשר (כתוב וחתום בחתימת הרב המכשיר –
לא
בעל פה, כי פתי יאמין לכל דבר),
ידע שהקלף של התפילין ומזוזות ספר תורה ומגילות שלו, 99% אחוז בא מהעכו"ם בלי
עיבוד לשמה.

סיפור נורא – איסור גזל
מספר תפילין ומזוזות כהלכתן דף 51
מלבד האחריות
כלפי מצוות שבין אדם למקום, קיימת לכשרות התפילין והמזוזות גם השלכה למצוות
שבין אדם לחבירו והיא: איסור גזל.
הקונה המשלם
מכספו תשמישי הקדושה מבקש לקבל תפילין או מזוזות
כשרות ללא פקפוק,
כאשר הוא מקבל, בלא ידיעתו, תפילין או מזוזות פסולות או מפוקפקות בכשרותן, עובד
המוכר על איסורי גזל והונאה החמורים.
סופר או מוכר
המוציאים מתחת ידם במשך שנים תפילין ומזוזות פסולים אינם יודעים בדרך כלל מי הם
האנשים שרכשו מהם. כאשר לא מכירים ואין אפשרות לבקש מחילה, כמעט ונמנעת דרך
התשובה ר"ל.
"עבירות שבין אדם
לחבירו, אין יום הכיפורים מכפר עד שירצה את חבירו".
במטרה להמחיש
את דרגת האחריות הגדולה שאליה הגיעו סופרים צדיקים בדורות שעברו, נספר על מקרה
שאירה בירושלים במאה הקודמת:
המקרה מסופר
על אחד מסופרי הסת"ם הצדיקים שהיו בירושלים שבין החומות בתקופתו של רבי שמואל
סלנט זצ"ל. אחד מהאנשים שרכשו אצלו תפילין, מסר את תפיליו לבדיקה כשנתיים לאחר
הרחישה והוברר שהתפילין היו פסולות מעיקרן. הקונה שבתפיליו התגלה הפסול הראה
לסופר את הפסול ואמר לו: "אלו התפילין שכתבת".
כאשר הסופר
הבחין בפסול הוא צנח ארצה מרוב בהלה ואיבד את הכרתו. רק לאחר עמל רב וממושך
הצליחו הנוכחים לעורר אותו מעלפונו.
כאשר הסופר
התעורר מהעלפון הוא פנה לקונה בקול מלא זעזוע וצער ואמר לו: ברצוני לומר לך
שלשה דברים:
ראשית הנחת
במשך שנתיים תפילין פסולות וחסרה לך מצוות תפילין לכן, הנני מעביר לך את הזכות
הרוחנית של הנחת תפילין שיש לי מכל אותן שתי השנים.
שנית, הנני
מחזיר לך עכשיו את המעות מלוא הסכום של התפילין שקנית ממני.
שלישית, אם
איראה תקלה כה חמורה.........וכו'.

ופסק שאני מחויב להחזיר הכסף לכל הקונים שלי, שהיות והקונה משלם לך הון תועפות
על הפרשיות והמזוזות והוא סומך עליך שאתה נותן לו פרשיות כשרים למהדרין, וע"ז
שילם לך. הרב אמר לי לפרסם שכל אחד שהולך לקנות סת"ם, יתנה עם הסופר בתנאי כפול
שיכתוב על קלף עם הכשר הכי טוב! וישאל אותו על איזה הכשר הוא רוצה לכתוב, יכול
להיות שיתוודע, שאם ההכשר הזה היה על דבר מאכל לא היה מכניס המאכל לפיו.

לרבנים הגדולים בחו"ל, ואמרו שזה שייך לרבני א"י, כי הסוחר גר בא"י, והרבנים
בא"י אמרו שזה שייך לרבני חו"ל שעושים שם הקלף, ובינו לבינו עברו עוד 20 שנה
שלא היה הכשר על הקלף.
